Accompanied by senior party members, the Patliputra MP handed over a formal application to station authorities, asserting that Chief Minister Choudhary breached statutory protections governing the privacy of minor crime victims.
Allegations of Statutory Violations Under POCSO Act
The core of Misa Bharti’s police complaint centers around the alleged disclosure of the minor victim's identity. According to the RJD leader, official communications and video materials shared from the Chief Minister's handle revealed identifiable details of the victim in the Jamui assault incident.
Under Section 23 of the Protection of Children from Sexual Offences (POCSO) Act, as well as relevant provisions of the Bharatiya Nyaya Sanhita (BNS) and guidelines laid down by the Supreme Court of India, publishing or broadcasting any material that reveals the identity of a child victim of sexual offences or harassment is strictly prohibited and constitutes a punishable offence. Bharti maintained that holding a constitutional office does not exempt anyone from statutory compliance regarding child safety and privacy mandates.
Police Action and Political Escalation
Addressing reporters outside the Secretariat Police Station, Misa Bharti claimed that police officials initially hesitated to register the FIR directly, citing procedural protocol. She stated that if local law enforcement fails to register a formal complaint against the Chief Minister, the party will approach senior police leadership and explore legal avenues through the court system.
The episode has intensified political sparring across Bihar. RJD leaders, including former Deputy Chief Minister Tejashwi Yadav, have launched sharp critiques against the state government, citing law enforcement lapses and privacy breaches.
